COVID 19 – While participating in deployment held or sponsored by Hurricane Pets Rescue Inc. (HPR), “social distancing” must be practiced, and face coverings worn “correctly”, covering nose and mouth should be worn at all times to reduce the risks of exposure to COVID-19.
Because COVID-19 is extremely contagious and is transmit it via person-to-person contact, contact
with surface as well as airborne transmission.
HPR has put in place preventative measures to reduce the spread.
That said HPR cannot guarantee that its participants, volunteers, partners, or others in attendance
will not become infected with COVID-19.
In light of the ongoing spread of COVID-19, individuals who fall within any of
the categories below should not engage in HPR’s events and/or other face to
face volunteer activities.
By volunteering with HPR, you certify that you do not fall into any of the following
categories:
1. Individuals who currently or within the past fourteen (14) days have experienced any symptoms
associated with COVID-19, which include fever, cough, and shortness of breath
among others.
2. Individuals who have traveled at any point in the past fourteen (14) days either internationally or to a community in the U.S. that has experienced or is experiencing sustained community spread of COVID-19; or
3. Individuals who believe that they may have been exposed to a confirmed or suspected case of
COVID-19 or have been diagnosed with COVID-19 and are not yet cleared as non-contagious by state or local public health authorities or the health care team responsible for their treatment. DUTY TO SELF MONITOR:
Volunteers agree to self-monitor for signs and symptoms of COVID-19 (symptoms typically include fever, cough, and shortness of breath) and, contact HPR at: info@hurricanepetsrescue.org
If he/she experiences symptoms of COVID-19 within 14 days after participating or volunteering with HPR.
LIABILITY WAIVER AND RELEASE OF CLAIMS:
I acknowledge that I derive personal satisfaction and a benefit by virtue of my participation and/or voluntarism with HPR, and I willingly engage in HPR’s deployment or intake of animals to my organization or both and/or other volunteering activities.
RELEASE AND WAIVER:
I,_________________________________ have voluntarily applied to assist Hurricane Pets Rescue Inc. (HPR) with the work referenced in the Position Description(s) for my volunteer role(s), and as specified in the Volunteer Agreement I signed.
By applying for and performing this volunteer work, I agree as follows and have initialed each item to indicate that agreement:
I am aware that this is a contract between me, my organization and HPR and that it waives legal rights that I may have now or in the future and releases HPR and others from claims for damages.
I myself as an individual, my shelter or rescue organization, are VOLUNTARILY PARTICIPATING IN THIS ACTIVITY WITH FULL KNOWLEDGE OF THE TASKS INVOLVED.
I AGREE TO ACCEPT ANY AND ALL RISKS ASSOCIATED WITH MY PARTICIPATION, INCLUDING BUT NOT LIMITED TO INJURY, ILLNESS AND DEATH.
1. I agree and understand there are risks and dangers associated with working with feral and domesticated animals, including but not limited to, bites, scratches, zoonotic diseases (diseases transmitted from animals to humans), and allergic reactions.
2. I also understand there may be risks involved with exposure to certain chemical cleaning products while performing my volunteer duties. I fully understand and accept those risks and dangers I fully assume all the risks involved with my volunteer activities, and acknowledge that they are acceptable to me.
3. I agree to use my best judgment in undertaking these activities.
4. I also agree to follow the rules and safety instructions as given by HPR directors and volunteers authorized to act in a supervisory capacity.
5. I agree that I will not sue, prosecute, or in any way make a claim against HPR for injury to me or damage to my property or my organization, resulting from the negligence or other acts, howsoever caused, by volunteers of HPR or other people as a result of my volunteer duties.
6. I fully and forever release and discharge HPR from any and all actions, causes of action, claims, liabilities, or demands I have or may have in the future, whether known or unknown, for injury, illness, death or damage arising out of or related in any way to my volunteer duties.
7. I agree that HPR may use my name, and pictures, photographs, or video and/or sound recordings of me on television, on radio, on the Internet, in emails, and in stories, news articles, advertisements, or other written or digital materials. I agree that such uses may include education, advocacy, and fundraising.
8. I agree that all pictures taken by myself while volunteering with Hurricane Pets Rescue are the property of Hurricane Pets Rescue and I must have full disclosure of them and be approved for the release of these pictures in any social media outlets or other internet place.
9. I agree that pictures, videos, etc. taken by while in partnership with HPR will need to disclose our partnership when posted anywhere online and on social media outlets.
10. I consent to and authorize, in advance, such use and agree that HPR does not have to notify me of such use or provide me with other consideration for such use. I waive any rights of privacy and/or publicity I may have in connection with these uses.
11. I agree that the rights I am giving up and agreements I am making apply equally to me and to my heirs, successors, assigns, guardians, and legal representatives.
12. I agree that none of those individuals may make any claim or take any action that I could not make or take myself.
13. I agree that this Waiver and Release of Liability protects and is for the benefit of Hurricane Pets Rescue and also for its affiliates, and their respective employees, officers, directors, consultants, interns, volunteers, licensees, and all others acting on their behalf. I also agree that I may not make any claim or take any action against any of those affiliates or individuals that I could not make or take against HPR itself.
14. I intend to fully and voluntarily waive any rights I have as described in this Waiver and Release of Liability.
To the extent that legal consideration is required for this Waiver and Release of Liability to be effective, I agree that I have received good, valuable and sufficient consideration by being permitted HPR to provide volunteer service and to receive training and instruction.
I HAVE CAREFULLY READ THIS WAIVER AND RELEASE AND FULLY UNDERSTAND ITS CONTENTS AND ACCEPT AND SIGN IT OF MY OWN FREE WILL.
If I am under 18 years of age at the time of registration, my parent or legal guardian has completely reviewed this Waiver and Release of Liability, understands, and consents to its terms, and authorizes my participation.
ASSUMPTION OF THE RISK. I acknowledge and understand the following:
1. Participation includes possible exposure to and illness from infectious diseases including
but not limited to COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist.
2. I knowingly and freely assume all such risks related to illness and infectious diseases, such
as COVID-19, even if arising from the negligence or fault of the Released Parties; and
3. I hereby knowingly assume the risk of injury, harm and loss associated with MY
VOLUNTEERING PARTICIPATION, including any injury, harm and loss caused by the
negligence, fault or conduct of any kind on the part of the Released Parties.
I DO HEREBY RELEASE AND FOREVER DISCHARGE THE RELEASED PARTIES FROM ANY CLAIM WHATSOEVER WHICH ARISES OR MAY HEREAFTER ARISE ON ACCOUNT OF ANY FIRST AID, TREATMENT, OR SERVICE RENDERED IN CONNECTION WITH MY PARTICIPATION IN THE ACTIVITY.
As volunteer, you recognize that your participation, involvement and/or attendance at any Hurricane
Pets Rescue Inc. event or activity is voluntary and may result in personal injury (including death) and/or property damage. By attending, observing or participating in the Activity, You acknowledge and assume all risks and dangers associated with your participation.
BY VOLUNTEERING WITH HURRICANE PETS RESCUE INC., YOU ARE DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW IN YOUR STATE.
